Novobeing VR Therapy Platform for Mental Health Professionals

Important: These Terms of Service govern your use of Novobeing's virtual reality therapy platform. By purchasing, accessing, or using our services, you agree to be bound by these terms.
This Terms of Service Agreement ("Agreement") is entered into between Novobeing Inc., located at Burlington Woods Dr. 100, Suite 1030, Burlington, MA, USA ("Novobeing," "we," "us," or "our"), and you, the mental health professional or practice ("Customer," "you," or "your") purchasing and using our VR therapy platform.

Payment is processed securely through Stripe, our trusted payment processor. Monthly subscription fees are billed in advance. Late payments may result in service suspension until account is brought current.
Monthly subscriptions automatically renew unless cancelled with 30 days written notice after the initial 30-day satisfaction guarantee period.
Risk-Free Trial: All new subscriptions include a 30-day satisfaction guarantee from the date of hardware delivery. You may cancel during this period and receive a full refund on both hardware and subscription fees, no questions asked.
Novobeing grants you a non-exclusive, non-transferable license to use our VR therapy software solely for therapeutic purposes within your professional practice. This license is valid only for the duration of your active subscription.
Novobeing retains all rights, title, and interest in and to the VR platform, software, content, and related intellectual property. You may not:
Upon payment and shipment, the VR hardware becomes your property. Novobeing is not liable for loss, theft, or damage after delivery.

You warrant that you are a licensed mental health professional authorized to provide therapeutic services in your jurisdiction. You agree to use our platform in accordance with:

Novobeing does not collect, store, or have access to your clients' personal health information (PHI) or personally identifiable information (PII). Our platform is designed with privacy-by-design principles.
We may collect anonymized usage data to improve our platform, including session duration, experience preferences, and technical performance metrics. This data cannot be linked to individual clients.
We maintain enterprise-grade security measures including encryption, access controls, and regular security assessments in accordance with healthcare industry standards.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
You agree to indemnify and hold Novobeing harmless from any claims, damages, or expenses arising from:
You may cancel your subscription at any time with 30 days written notice after the initial 30-day guarantee period. Upon cancellation, you retain ownership of hardware but lose access to software and support services.
We may terminate your access for material breach of these terms, non-payment, or violation of applicable laws. We will provide 30 days notice when possible, except for immediate termination due to security concerns or legal requirements.
Novobeing may update these Terms of Service from time to time. We will notify you of material changes via email or through our platform. Continued use after notification constitutes acceptance of updated terms.
This Agreement is governed by the laws of the State of Massachusetts. Any disputes will be resolved through binding arbitration in Massachusetts, except for claims involving intellectual property rights.
Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, government actions, or technical failures of third-party services.
These Terms of Service constitute the entire agreement between you and Novobeing regarding your use of our platform, superseding any prior agreements or communications.
